Section 20:04:30:93 - Trifecta pools and wageringAny association licensed by the commission to conduct pari-mutuel racing meetings may with the approval of the commission conduct a trifecta pool, subject to the following limitations:
(1) The trifecta pool is a part of the pari-mutuel system of wagering. It is a contract between the association and the purchaser of a ticket combining three runners in a single race, selecting the runners that will finish first, second, and third in that race;(2) Races in which trifecta pools are conducted must be approved by the commission and must be clearly designated in the program;(3) Payment of the ticket may be made only to a purchaser who has selected the same order of finish as officially posted;(4) The trifecta is not a parlay and has no connection with or relation to the win, place or show betting. It shall be calculated in a separate pool;(5) If a runner is scratched or declared a nonstarter, no further trifecta tickets may be issued designating that runner. All tickets previously issued designating that runner shall be refunded and the money deducted from the gross pool;(6) Coupled entries and fields are prohibited in trifecta races;(7) If no ticket is sold on a winning combination of a trifecta pool, the net pool shall be apportioned equally between those having tickets selecting the first and second place runners. If no ticket is sold selecting the first and second runners in the trifecta pool, the net pool shall be apportioned equally between those having tickets selecting the runner or runners that finished in the trifecta race;(8) If no selection is made as described in subdivision (7) of this section, the total number of tickets selecting the second runner for second and the third runner for third with any other runner shall divide the net pool and be paid the same payoff price;(9) If there is a dead heat for first place, the winning combinations shall be the first two runners as finishing in either position and the runner finishing third. If there is a dead heat to place, the winning combinations shall be the runner finishing first and the two runners finishing in a dead heat for place, as finishing in either position. If there is a dead heat for third, the winning combinations shall be the runner finishing first, the runner finishing second, and the two runners finishing in a dead heat for third, as finishing in either position. All combinations described in this subdivision shall be divided into separate pools, calculated as place pools, and paid off accordingly;(10) If there are triple dead heats or double dead heats, all such combinations formed shall be aggregated into one common pool which shall be calculated as a win pool and paid off accordingly;(11) If less than three horses finish, the payoff shall be made to holders of tickets selecting the finishing horses in order, ignoring the balance of the selection; and(12) If no ticket is sold that requires distribution of the net trifecta pool to a winner as provided in this section, the association shall make a full refund of the trifecta pool.S.D.
