The stewards may determine the extent of disqualification in case of fouls. They may place the offending horse behind those horses that in their judgment it interfered with, or they may place it last. The order or ruling of the stewards as to the extent of disqualification of a horse for a foul or interference in a race or as to a finding of fact concerning an occurrence during or incident to the running of a race constitutes final agency action under SDCL 42-7-96 after notice and hearing. A person requesting a hearing to determine the extent of disqualification in case of foul shall follow the procedure set forth in § 20:04:01:13.02.
