Section 65-234 - Dismissal and DecisionsA. If a timely election is filed to have the claims asserted in the complaint decided in a civil action, the Chief Hearing Commissioner shall dismiss the administrative proceeding.B. A Chief Hearing Commissioner may not continue an administrative proceeding under this Rule regarding an alleged discriminatory housing practice after the beginning of the trial of civil action commenced by the aggrieved person under an act of Congress or a state law seeking relief with respect to that discriminatory house practice. If such a trial is commenced, the Chief Hearing Commissioner shall dismiss the administrative proceeding. The commencement and maintenance of a civil action for appropriate temporary or preliminary relief under the Act does not affect administrative proceedings under this Rule.Added by State Register Volume 16, Issue No. 6, eff June 26, 1992.
