Section 61-119.J.2 - Transferability of Permitsa. Surface water permits are transferable with the prior written consent of the Department provided: i. the current permittee notifies the Department at least sixty (60) days in advance of the proposed transfer date; andii. the activities and uses of the new permittee are consistent with the activities of the original permittee.b. In determining whether to allow the transferring of a permit, the Department will consider: i. whether the use to be made of the water by the new permittee is consistent with the previous use;ii. the quantity of water to be used by the new permittee as compared to permitted amount and previous use;iii. if consumptive use under the new permittee is consistent with the previous permittee; andiv. the location of water use under the new permittee.c. Depending on the specifics of the proposed transfer, the Department may transfer the permit as originally issued, transfer the permit at a decreased flow or deny the transfer.S.C.
