Section 810-RICR-00-00-1.31 - Judicial ReviewA. Appeal from Commission Orders. Any person aggrieved by a written order of the Commission, other than a telecommunications interconnection order, may, within seven (7) days from the date of such order, petition the Supreme Court for a writ of certiorari to review its legality and reasonableness. The petition for a writ of certiorari shall fully set forth the specific reasons for which it is claimed that the decision or order is unlawful or unreasonable. Parties appealing a Commission decision with regard to a telecommunications interconnection order shall file in the United States District Court for the District of Rhode Island pursuant to the Telecommunications Act of 1996, 47 U.S.C. § 252.B. Judicial Review of Rules. The validity or applicability of any rule may be determined in an action for declaratory judgment in the Superior Court of Providence County, when it is alleged that the rule, or its threatened application, interferes with or impairs, or threatens to interfere with or impair, the legal rights and privileges of the plaintiff.
