Section 490-RICR-00-00-6.1 - General Provisions6.1.1Scope and Construction of RulesA. The following shall constitute the regulations governing disposition of appropriations for the purpose of providing twenty-five (25) percent and/or fifty (50) percent of the cost of approved water transmission facilities for public water supply pursuant to R.I. Gen. Laws Chapter 46-15.2, as amended. These rules prescribe procedures for application, minimum standards of conduct of grantees, and performance standards for the development of potable water transmission facilities.B. The regulations shall be liberally construed to permit the Board to effectuate the purpose of the law.6.1.2Purpose of RulesA. These rules are promulgated for the following purposes:1. To implement the purposes and objectives of the Rhode Island Water Facilities Program, R.I. Gen. Laws Chapter 46-15.2, as amended;2. To establish policies and procedures for administration of funds appropriate for the purpose of granting to municipal and quasi-municipal, potable water supply agencies twenty-five (25) percent and/or fifty (50) percent, as the case may be, of the cost of the development of approved potable water transmission facilities;3. To protect the public and State of Rhode Island by ensuring that funds appropriated are spent in a proper manner and for the intended purposes;4. To ensure that the distribution and use of appropriated funds are consistent with the laws and policies of the State of Rhode Island;5. To establish minimum standards of conduct to prevent conflicts of interest and ensure proper administration of grants;6. To establish accounting procedures for administration of grants.6.1.3Practice Governing RulesThe Board may rescind, amend, or expand these procedures from time to time in conformance with the Administrative Procedures Act, R.I. Gen. Laws Chapter 42-35, as amended.
6.1.4Procedure for Obtaining a Water Facilities Assistance GrantA. Each potential applicant for a water facilities assistance grant shall: 1. Determine if it meets the eligibility criteria of §6.2.3 of this Part;2. Arrange for a preapplication conference as required in §6.2.4 of this Part;3.
