Preliminary Decision and Advisory Opinions - The preliminary decision of the Board and advisory opinions of designated agencies are interlocutory decisions for which judicial review is not available until the Board issues its Final Decision.B. Final Decision, Judicial Review - Judicial review of a Board decision is governed by R.I. Gen. Laws § 42-98-12.C. Judicial Review of Rules - The validity or applicability of any rule of the Board may be determined in an action for declaratory judgment in the Superior Court of Providence County, when it is alleged that the rule, or is threatened application, interferes with or impairs, or threatens to interfere with or impair, the legal rights and privileges of the plaintiff. The Board shall be made a party to the action.445 R.I. Code R. 445-RICR-00-00-1.16
