Section 290-RICR-40-00-1.1 - Authority1.1.1Legal AuthorityA. The Rhode Island Department of Transportation with respect to highways under their jurisdiction is empowered under R.I. Gen. Laws § 31-25-21 to issue special permits to applicants that operate or move a vehicle or combination of vehicles that exceed size and weight restrictions specified in R.I. Gen. Laws Chapter 31-25.B. The Department of Transportation is also authorized by R.I. Gen. Laws § 31-25-1(b) to promulgate rules and regulations for the application and issuance of permits for oversize and overweight vehicles or loads.C. The following rules and regulations shall amend the rules and regulations for overweight and oversize vehicles issued on April 23, 1978, June 21, 1976 and February 8, 1974, and shall supersede all overweight and oversize permit policies previously established by the Department of Transportation.1.1.2SeverabilityIf any provisions of these rules and regulations or the application thereof to any person or circumstances shall be held invalid, such invalidity shall not affect the provisions or application of the rules and regulations which can be given effect, and to this end the provisions of these rules and regulations are declared to be severable.
