Section 216-RICR-50-05-6.3 - System Eligibility
A. Community public water systems and nonprofit noncommunity public water systems, both privately organized water suppliers and local governmental units, are eligible to receive assistance from the DWSRF.
B. Lack of technical, managerial and financial capability
1. Public water systems that lack the technical, managerial or financial capability to maintain compliance with the "Rules and Regulations Pertaining to Public Drinking Water" are not eligible to receive funding from the DWSRF unless the owner or operator of the system agrees to undertake feasible and appropriate changes in operation, or if the use of the financial assistance from the DWSRF will ensure compliance. See § 6.9 of this Part for further discussion on capacity development.
C. Significant noncompliance
1. Public water systems that are in significant noncompliance with the "Rules and Regulations Pertaining to Public Drinking Water", as determined by the Director, are not eligible to receive funding from the DWSRF unless the Director determines that the project will enable the system to return to compliance and the system will maintain an adequate level of technical, managerial and financial capability to maintain compliance.
