These rules are promulgated pursuant to the authority set forth in R.I. Gen. Laws Chapter 40-8 (Medical Assistance) and various sections in the R.I. Gen. Laws including §§40-8-32 and 23-17.5-15 related to rights of nursing facility residents; 42 C.F.R. § 483.10; and Title XIX of the Social Security Act, 42 U.S.C. §§ 1396 - 1396w - 7. Additional authority is derived from the State's Medicaid State Plan and the Rhode Island Comprehensive Section 1115 D emonstration, as approved in final form on February 25, 2014, and as subsequently amended.
