Section 200-RICR-20-20-2.1 - PreambleA. Legal authority 1. These rules and regulations are promulgated in accordance R.I. Gen. Laws § 16-60-1, et seq. and in accordance with the obligation of the Rhode Island Council on Elementary and Secondary Education ("the Council") to "approve the .instructional standards required to be maintained in the public elementary and secondary schools of the state" R.I. Gen. Laws § 16-60-4(9)(i), and "to adopt standards and require enforcement and to exercise general supervision over all elementary and secondary public .education in the state.." R.I. Gen. Laws § 16-60-4(3).2. These regulations support the requirement of the federal Elementary and Secondary Education Act ("ESEA") that school districts must certify that, ". all teachers in any language instruction educational program for limited English proficient children that is, or will be, funded under this part are fluent in English and any other language used for instruction, including having written and oral communications skills."20 U.S.C. § 6826(c).200 R.I.
