(a) Food stored, prepared or served shall be clean, wholesome, free from spoilage, free from adulteration and safe for human consumption.(b) Food handling practices shall conform to the requirements of the Department of Health or the Department of Environmental Resources or its delegate agency where the child care facility is located.(c) Food that has been previously served to a person or returned from a table shall be discarded.(d) Potentially hazardous food brought from the child's home or provided by the facility shall be refrigerated.(e) Fresh fruits and vegetables that are not used on the day of purchase shall be refrigerated.(f) The only canned foods permitted for children's consumption are those commercially preserved in airtight jars or cans.(g) A facility shall provide a sufficient number of refrigerators to contain foods which require refrigeration.The provisions of this §3270.161 amended December 18, 2020, effective 12/19/2020, 50 Pa.B. 7133.The provisions of this §3270.161 amended under Articles IX and X of the Human Services Code (62 P.S. §§ 901-922 and 1001-1088).
