Section 2390.126 - Access(a) A client, and the parent or guardian, if the client is under 18 years of age or if the client is legally incompetent, shall have access to the records and to information in the records. If the interdisciplinary team documents, in writing, that disclosure of specific information constitutes a substantial detriment to the client or that disclosure of specific information will reveal the identity of persons or breach the confidentiality of persons who have provided information upon an agreement to maintain their confidentiality, that specific information identified may be withheld.(b) The client record is the property of the facility whose responsibility is to secure the information against loss, defacement, tampering or use by unauthorized persons. Client records shall be removed from the facility's jurisdiction and safekeeping only in accordance with a court order, subpoena or statute.The provisions of this §2390.126 adopted May 9, 1986, effective 8/8/1986, 16 Pa.B. 1693.
