Section 289.227 - Air resources protection(a) The operator shall implement fugitive air contaminant control measures and otherwise prevent and control air pollution in accordance with the Air Pollution Control Act (35 P. S. §§ 4001-4015); Article III (relating to air resources) and § 289.228 (relating to nuisance minimization and control). Minimization and control measures shall include the following: (1) Ensuring that operation of the facility will not cause or contribute to an exceedance of an ambient air quality standard under § 131.3 (relating to ambient air quality standards).(2) Ensuring that no open burning occurs at the facility.(3) Minimizing the generation of fugitive dust emissions from the facility.(b) The operator shall comply with the terms and conditions of an air quality plan approval and air quality operating permit issued to the facility.The provisions of this §289.227 amended January 12, 2001, effective 1/13/2001, 31 Pa.B. 235.
