Section 109.412 - Special notice of the availability of unregulated contaminant monitoring results(a)Timing for a special notice. A community water system or nontransient, noncommunity water system required to monitor for an unregulated contaminant under 40 CFR 141.40 (relating to monitoring requirements for unregulated contaminants) shall notify persons served by the system of the availability of the results of the sampling no later than 12 months after the monitoring results are known.(b)Delivery of a special notice. The delivery of the public notice shall follow the requirements for a Tier 3 public notice prescribed in § 109.410 (relating to Tier 3 public notice-categories, timing and delivery of notice). A public water system may use an annual report or CCR to notify persons served by the system of the availability of the results of the sampling as long as the requirements under § 109.410(d) are met. The notice must also identify a person and provide the telephone number to contact for information on the monitoring results.The provisions of this §109.412 adopted August 9, 2002, effective 8/10/2002, 32 Pa.B. 3894; amended May 8, 2009, effective 5/9/2009, 39 Pa.B. 2334.The provisions of this §109.412 amended under section 4 of the Pennsylvania Safe Drinking Water Act (35 P.S. § 721.4) and sections 1917-A and 1920-A of The Administrative Code of 1929 (71 P.S. §§ 510-7 and 510-20).
