Section 106.53 - Inadequate or collapsed structures(a) The owner or permittee of any highway obstruction or obstruction shall immediately inform the Department of the collapse of the highway obstruction or obstruction or any portion thereof or of the existence of any unusual conditions threatening the structural integrity of the highway obstruction or obstruction, where the collapse of the highway or structure would adversely affect the passage of floodwaters.(b) Whenever a highway obstruction or obstruction, or any portion thereof has collapsed or is in imminent danger of collapse, and the collapsed portions may adversely affect passage of floodwaters or endanger health and safety, the owner or permittee shall immediately remove any and all collapsed portions to an area outside the floodplain of the stream and either:(1) Completely remove the highway obstruction or obstruction.(2) Repair the highway obstruction or obstruction under plans submitted to and approved by the Department.
