Section 76.51 - Construction requirements(a) The development agency shall provide and maintain competent and adequate engineering supervision and inspection for the project to insure that the construction conforms with the approved plans and specifications.(b) A construction contract shall provide that representatives of the Department, as appropriate, will have access to the work whenever it is in preparation or progress. The contract shall also provide that the Department will have access to books, documents, papers and records of the contractor which are pertinent to the project for the purpose of making audit, examination, excerpts and transcriptions thereof.(c) The development agency shall construct the project or cause it to be constructed as approved by the Department.The provisions of this §76.51 adopted December 13, 1974, effective 12/30/1974, 4 Pa.B. 2529; amended January 30, 1976, effective 2/16/1976, 6 Pa.B. 157.
