Section 635-430-0050 - Wildlife Habitat Conservation and Management Plan ContentPlans developed after the effective date of these rules shall include the following elements:
(1) Certification from the city or county, on a Department form, that the subject property is within an area or zone designated for participation in the Wildlife Habitat Conservation and Management Program;(2) The name, mailing address, site address, email, and telephone number of the landowner;(3) The name, affiliation, address, email and phone number of the cooperating agency;(4) The township, range, section, tax lot number(s), zoning and county of the subject property;(5) The acreage of the subject property and the acreage of land proposed for enrollment in the Program. The acreage of land proposed for enrollment shall not include dwellings;(6) An aerial photograph of the subject property that clearly distinguishes the features and boundaries of the property;(7) Map(s) and written descriptions of the physical features, vegetation, and native habitats of conservation concern that currently exist on the subject property. The map(s) shall be readable, reproducible, and based on current technology. The map(s) shall display the following:(a) Areas of native habitats of conservation concern such as those identified in the Oregon Conservation Strategy;(b) Rivers and intermittent and perennial streams (including names);(c) Lakes, ponds and other water bodies;(d) Wetlands and riparian areas;(e) Other areas identified in the local comprehensive plan as significant wildlife habitat; Dwellings, roads, fences and other artificial structures.
(8) A description of:(a) The wildlife habitat conservation and management objectives to be achieved; and(b) The conservation and management practices that will be conducted to preserve, enhance or improve the structure or function of wildlife habitat on the subject property; and(c) The long-term maintenance plan for the property.(9) Time frames to implement each conservation and management practice identified in 8(a-c) above.(10) Map(s) and written descriptions of the physical features, vegetation, and native habitats of conservation concern reasonably expected to exist on the subject property after implementation of the conservation and management practices described in OAR 635-430-0030, including the location of areas managed for farming or forestry, native habitats of conservation concern, control of invasive species, existing and proposed dwellings and other proposed structural improvements, and monitoring points. The map(s) shall be readable, reproducible, and based on current technology.(11) Signed acknowledgment by the landowner or trustees with a commitment to the following: (a) Long-term active maintenance of the property following the implementation of the Plan and reporting the results of wildlife habitat conservation and management objectives and actions;(b) Maintaining the capacity, tools, and resources to actively manage and maintain the habitat on the acres of the subject property that are enrolled in the Program for the length of time that they own the property;(c) Submitting a yearly self-attestation report in accordance with 635-430-0080 (1) with relevant photographs that document the status of Program management activities in relation to the goals and outcomes outlined in the Plan and that they shall continue to actively manage the property as required to maintain enrollment in the Program.(d) Understanding that failure to submit an annual update to the Department shall result in disqualification from the Program, which may have potential tax liability for the landowner.
