Section 800:1-10-7 - Duties of investigators and Division Chiefs in regard to complaints The following outlines the duties and responsibilities of investigators and Division Chiefs in regards to complaints.
(1)The investigator will:(A) Perform a prompt, thorough and impartial investigation of the complaint or matter assigned for investigation by the Director.(B) Prepare and submit in proper format to the Director a complete, accurate written report for each investigation performed.(C) Perform staff functions, as follows, concerning all internal investigation: (i) Review each case (complaint or matter for investigation) received from the Director.(ii) Assign control number of each case received and record the number in a log book and on the copies of the case. (iii) Review and check for proper format, completeness and accuracy of all investigative reports received. (iv) Perform supplemental investigations when necessary, as directed, and prepare an submit proper reports of such investigations to the assigning authority.(v) Notify the Director when an investigation is being interfered with or if the employee being investigated or interviewed is uncooperative.(2)The Human Resource Administrator will:(A) File in the appropriate personnel file, a copy of all investigated citizen complaints including a copy of each complaint, a copy of each completed investigative report, a copy of all related correspondence, the findings of the Department and the final disposition of each case.(B) Maintain proper security of all information and files pertaining to internal investigations and allow access to such information of files only to persons having authorization from the Director.(C) Acknowledge receipt of each citizen complaint. All formal complaints shall be acknowledged by letter, advising the complainant that an investigation of his/her complaint is being, or will be, conducted and that he/she will be contacted personally (or by other means, as necessary, if out of state) by an investigator.(D) On citizen complaints, notify by letter the employee(s) complained against that a complaint has been received and is being or will be, investigated, unless such notification might jeopardize the investigation of the complaint. Such letter shall include the name of the complainant and the nature of the complaint along with a copy of the complaint. (E) On all citizen complaints, notify the complainant by letter (over the appropriate authority's signature) of the findings of the Department and whether the Department proposes to take corrective administrative action.(F) On all citizen complaints against personnel, notify by letter (over the appropriate authority's signature) the employee(s) complaint against the findings of the Department and the action, if any, which the Department proposes to take.Okla.
