Section 260:65-23-2 - Fees for services
(a)General Provisions. Upon requesting specific services, a state agency shall submit a requisition or request form prescribed by the Director which states the service requested and verifies the corresponding fee from the schedule provided published by the Department. When required by the fee schedule, the Agency shall attach a purchase order for the specified fee amount, listing the Department as the vendor. The Department will invoice the Agency for the specified fee upon completion of the service. The fee is for a service provided by the Department and is fulfilled by the specified action by the Department. The fee is not contingent on the performance of an outside vendor retained as a result of the service rendered by the Department.
(b)Establishment of fees. The Department shall establish a fee schedule for services provided by the Department. The fee schedule shall be published on the OMES website and shall not become effective earlier than the 31 st day following such publication. Services covered by the fee schedule shall include but not be limited to providing or contracting for architectural, engineering, land surveying, planning, real estate, contract management, notification of solicitations, and related services. The Department shall not increase fees more than once per fiscal year. Prior to adopting an increase in fees, the Department shall notify the Governor, the President Pro Tempore of the Senate, and the Speaker of the House of Representatives. The Department may decrease fees at any time without prior notification.
(c)Methodology. Fees shall be established according to the Department's best calculation or approximation of its cost for providing each service, taking into account the project size, complexity, and management time and effort required by the Department for that category of services.
