Section 165:59-3-61 - Forms for requesting OUSF administrative preapproval and Special Universal Service funding
(a) The appropriate forms necessary for making a Special OUSF funding request shall be consistent with 17 O.S. §139.106(D)(4) and the appropriate forms necessary for making an OUSF administrative preapproval request shall be consistent with 17 O.S. § 139.109.1(F)(2)(a).
(b) The Administrator shall post the forms for an OUSF administrative preaproval request on the Commission's website no later than June 30 of each year to become effective for any OUSF administrative preapproval requests submitted after August 31 of that year. Objections to the preapproval forms must be filed with the Commission no later than 15 days after the forms are initially posted. If the objection results in the forms being further revised from what was initially posted, then the forms as approved after resolution of the objection shall be posted and thereafter used for requesting funding.
(c) The Administrator shall post the forms for requests seeking OUSF funds for Special Universal Services no later than one hundred and twenty (120) days prior to the start of funding year to become effective on July 1 for reimbursement requests submitted during the funding year.
(d) Any party objecting to the forms used for seeking Special Universal Services funding shall file an Application in the Commission's Court Clerk within fifteen (15) calendar days of the form being posted on the Commission's website. Notice of the objection shall be given to the Administrator, the Oklahoma Attorney General, and shall be posted on the Commission's website by the Administrator within three (3) calendar days of the filing of the objection.
(e) Objections shall provide details sufficient to allow the Commission to fully evaluate the Objections. The Commission may, within its sole discretion, conduct a hearing to resolve the dispute. If the Commission opts to conduct a hearing, it shall provide at least five (5) calendar days notice to the parties in the case. Any interested person may participate in the hearing by filing an entry of appearance and a statement of position setting forth their position on the objection. The entry of appearance and statement of position shall be served on all parties to the case.
(f) The Commission shall issue a final order on the objection to the form within thirty (30) calendar days of the objection being filed, or if no order is issued, then the objection shall be deemed approved, and the form modified accordingly.
