I, FRANK KEATING, Governor of the State of Oklahoma, by virtue of the power and authority vested in me by law, hereby amend Executive Order 1993-20 which established the Oklahoma Developmental Disabilities Council, and named the Department of Human Services as its designated state agency.

The Federal Developmental Disabilities Assistance and Bill of Rights Act, P.L. 106-402 and as subsequently renumbered, establishes State Councils on Developmental Disabilities and provides payments to states to assist in the development of a comprehensive and coordinated system of services for persons with developmental disabilities.

The State of Oklahoma is required, as a condition of receiving such federal assistance, to conduct appropriate planning and coordination, encompassing administrative activities, federally-defined areas of emphasis, and state priority areas.

The ultimate objective of these activities is to enable persons with developmental disabilities to achieve their maximum potential through increased independence, productivity, and integration and inclusion into the community.

To obtain such financial assistance, the State of Oklahoma must establish a State Council on Developmental Disabilities. This Council is required to develop a plan, approved by the U.S. Secretary for Health and Human Services, which promotes a comprehensive array of services and support for Oklahomans who have developmental disabilities.

Members of the State Council on Developmental Disabilities are appointed by the Governor from among Oklahoma residents in a manner consistent with federal law. The Governor of the State of Oklahoma must make appropriate provisions for membership rotation of the State Council on Developmental Disabilities.

Federal law provides for the Governor to designate a state agency to assist in the administration of the available federal grants and such designation is to be made following consideration of comments of the general public and the non-state agency members of the State Council on Developmental Disabilities, and after the Governor has made an independent assessment of the impact that the designation of such agency has on the ability of the State Council on Developmental Disabilities to serve as an advocate for persons with developmental disabilities.

The following terms and conditions shall apply to the Oklahoma Developmental Disabilities Council:

1. Membership of the Council and rotation of membership shall meet the guidelines established in the Developmental Disabilities Assistance and Bill of Rights Act. All members serve at the Governor's pleasure. Except for mandated agency representatives, all members of the Council shall serve terms no longer than four years. No member shall serve more than eight consecutive years.
2. The Governor shall appoint the Council Chair.
3. The Council shall cease to exist upon the enactment of federal legislation abolishing its necessity.

The Oklahoma Developmental Disabilities Council shall prepare and submit, in conjunction with the Oklahoma Department of Human Services, a State Plan for Developmental Disabilities in compliance with the Developmental Disabilities Assistance and Bill of Rights Act.
