Section 5139-69-01 - Creation of a youth with problematic sexual behavior treatment program certification advisory board(A) There is hereby created within the department of youth services a youth with problematic sexual behavior treatment program certification advisory board. The advisory board's responsibilities will be to direct the inspection and monitoring of youth with problematic sexual behavior treatment programs. The advisory board will recommend the certification of such treatment programs to the director of the department of youth services. The advisory board will monitor and recommend certification for such programs solely for the purposes of compliance with section 2950.16 of the Revised Code.(B) The seven-member advisory board will consist of representatives from the following juvenile specific areas: (1) Community corrections;(3) Ohio department of youth services (DYS);(7) Supervision / transition / reentry services(C) A youth with problematic sexual behavior treatment program shall apply, in writing, to the advisory board for certification. The application for certification will be available on the department of youth services website. The program may be recommended for certification if it complies with the standards established by the advisory board. The advisory board shall establish standards that address the following:(1) Statement of philosophy, including goals and model of treatment;(2) The theoretical principles and operating methods employed to treat clients;(3) The scope of services offered.(D) If the advisory board does not recommend certification for an applying program, the advisory board will notify the treatment program, in writing, of the reason for the decision not to make a recommendation. The advisory board will reconsider their decision not to recommend a program for certification upon the request of the treatment program if submitted within sixty days of the advisory board's written decision. Such a request must be accompanied by additional or supplemental information that was not included in the original request for certification. If deficiencies have not been corrected within the timeframe specified, the advisory board will withhold any further consideration of the application for a period of one year from the date specified and the advisory board will require that a new application be submitted after one year. The certification will be invalid during that year.(E) The advisory board will monitor the performance of each certified youth with problematic sexual behavior treatment program annually. To maintain certification, the treatment program must show maintenance of the standards established by the advisory board.(F) If the advisory board recommends revocation of certification for failure to maintain the standards established by the board, they shall notify the treatment program, in writing, of the reason for the revocation. The certification will be terminated sixty days from the receipt of the revocation notice from the advisory board unless a reconsideration is requested pursuant to paragraph (D) of this rule.(G) The advisory board shall reconsider the recommendation of the revocation of a certification upon the written request of the treatment program if submitted within sixty days. Such a request must be accompanied by additional or supplemental information. The advisory board shall act upon the request for reconsideration within thirty days from the receipt of the request. If the advisory board determines that revocation of certification is appropriate, the board will follow the procedure for termination pursuant to paragraph (D) of this rule. A program may request a reconsideration of the revocation of certification only once.(H) The advisory board shall maintain a list of certified youth with problematic sexual behavior treatment programs open to public inspection on the department of youth services website.
