The Department of Corrections and Rehabilitation is not an administrative agency, for purposes of jail rules, under North Dakota Century Code Section 28-32-01. The department has requested removal of the rules in Article 94-02 from the Administrative Code because the rules have been superseded by more recent rules adopted by the department to govern correctional facilities. The more recent rules are not published in the Administrative Code.
