Section 75-03-40-39 - Runaway notification1. A facility shall have written policies and procedures for notification if a resident has left the facility without permission or fails to return to the facility after an approved leave. Facility policy and procedures must detail how the determination is made that a resident is missing and must identify the employee designated to promptly complete notifications.2. Facility notifications include: a. Law enforcement officials and custodian and parent or guardian immediately after the facility confirms the whereabouts of the resident are unknown; andb. The department's interstate compact administrator within forty-eight hours of an out-of-state resident's absence.3. When the resident is found, the facility shall report the resident's return immediately to the law enforcement officials and the resident's custodian and parent or guardian.N.D.
