Section 33-44-01-47 - Standards for pesticides and degradation compounds compliance testing1. A batch fails pesticide and degradation compound testing if a sample does not satisfy the most stringent acceptable standard for a pesticide chemical residue in any food item as set forth in subpart C of the United States environmental protection agency's regulations for Tolerances and Exemptions for Pesticide Chemical Residues in Food, 40 CFR 180, in effect as of January 1, 2018. A batch of dried leaves and flowers failing pesticide and degradation compound testing is considered affected or contaminated.2. A degradation compound identified in testing must be reported to and reviewed by the department. The department, in consultation with the laboratory, shall determine whether the batch is considered to be affected or contaminated and fails pesticide and degradation testing.3. If the samples do not pass testing standards for pesticides and degradation compounds, the manufacturing facility shall comply with section 33-44-01-52.N.D. Admin Code 33-44-01-47
