Section 06Q .0101 - ADDITIONAL GROUNDS FOR DENIAL OR DISCIPLINEExcept as provided in Chapter 86A of the General Statutes, the Board:
(1) shall find fraudulent misrepresentation in the following examples: (a) An individual or entity operates or attempts to operate a barber shop or barber school without a permit;(b) An individual or entity advertises barbering services unless the establishment and personnel employed therein are licensed or permitted;(c) An individual or entity uses or displays a barber pole only if the use of the barber pole is for the purpose of offering barber services to the public without a barber shop or barber school permit. This Rule does not prohibit use of a barber pole for purposes other than offering services that require a certificate of registration, license, or permit under G.S. 86A; and(d) An individual or entity fails to produce a license or permit as defined by 21 NCAC 06P .0103(7) upon the request of the Board's Executive Director or a Board inspector during an inspection;(2) will determine whether grounds for denial or discipline exist when: (a) An individual violates a settlement agreement entered into with the Board;(b) An individual or entity violates G.S. 86A or any rule adopted by the Board for barbers, barber shops or barber schools; or(c) An individual fails to disclose a felony criminal conviction in dealing with the Board.21 N.C.
