Section 08B .0106 - APPLICATION PROCESS: STEP FIVE: INITIAL SCREENING(a) The chief shall select two persons to serve as a BPS Applicant Screening Team. This team shall be responsible for processing applicants as provided in this Subsection.(b) The chief shall notify qualified applicants by mail to report to a designated location at a designated time for the purpose of initial screening. Initial screenings will be scheduled based upon the needs of BPS. If an applicant fails to appear for an initial screening, he/she may be given one alternate date for initial screening. Failure of an applicant to comply with the second initial screening date will disqualify him/her for further consideration at that time and the applicant will not be eligible to reapply for employment with BPS for 12 months.(c) Members of the BPS applicant screening team shall accomplish the following during the initial screening: (1) Require each applicant to write a brief statement stating why he/she wishes to become a member of BPS.(2) Explain the benefits and working conditions of the BPS. This shall include an explanation of the salaries and fringe benefits, duties and responsibilities and risks involved in law enforcement and firefighting, work schedules, opportunities for advancement, promotion procedures, military leave policy, retirement provisions, workers' compensation, and sick leave and annual leave policy.(3) Explain to each applicant that, upon successful completion of the Basic Training School required by BPS, each member must serve a 12-month probationary period, during which time his/her performance as a member will be under continuous evaluation by his/her superiors. At any time during the probationary period and at the end of such period the chief shall evaluate his/her performance and determine whether he/she may continue as a member. The team shall also explain to each applicant that members of BPS are subject to the provisions of Chapter 126 of the General Statutes of North Carolina, and pursuant thereto, do not become "permanent state employees" until such time as they have been continuously employed by the State for five years.(4) Ask each applicant to read and sign a form acknowledging that the applicant understands the requirements set forth in this Rule, accepts those conditions, and still wishes his/her application for employment as a member to remain under consideration.(5) Applicant's weight must be commensurate with height as established by the BPS Medical Services Director: HEIGHT (WITHOUT SHOES) | MAXIMUM ACCEPTABLE WEIGHT |

(6) Determine if each applicant meets the citizenship requirement. An applicant must be a citizen of the United States, and must have been a legal resident of or resided in North Carolina for 12 months immediately preceding the date of application.(7) Determine each applicant's criminal history as far as can be determined by an interview. An applicant must not have pleaded guilty to, entered a plea of no contest or have been convicted of any crime other than a minor misdemeanor which does not adversely reflect upon the professional image of BPS. No applicant will be accepted who, during the three years preceding the date of his/her application, has pleaded guilty to, entered a plea of no contest to, or has been convicted of a traffic offense which requires suspension or revocation of driving privileges. An applicant who has accumulated more than eight points against his/her driving record during the preceding three years will not be eligible for employment as a member.(8) Inform each former member that he/she shall be subject to all requirements for employment as set forth in this Section, including successful recompletion of the Basic Training School required by BPS.(9) Administer an agility test. An applicant must perform on an agility test according to standards established by the BPS Medical Services Director.(10) Obtain a notarized release, signed by each applicant, authorizing any BPS member or person authorized by the chief to obtain appropriate documents and background information concerning the applicant, including medical history information.(11) Determine whether the applicant meets minimum age requirements. The minimum age is 20 years, as of the date of application. The maximum age is 33 years, as of the date of applicant's first day of the BPS Basic Training School.(12) Inform each applicant that relatives of a BPS member may not be employed by the BPS Division. Relatives includes wife, husband, mother, father, brother, sister, son, daughter, mother-in-law, father-in-law, son-in-law, daughter-in-law, grandmother, grandfather, grandson, granddaughter, stepmother, and stepfather. It might also include others living within the same household or otherwise so closely identified with each other as to suggest that problems might be created.(13) Forward to the chief the results of information received during their initial screening.(d) If an applicant fails to satisfactorily comply with or meet requirements set forth in this Regulation, the chief will so notify each applicant by mail that he/she has been rejected and cannot reapply for 12 months. The applicants who successfully meet all requirements identified in this Regulation shall undergo a background investigation by the chief or a designated member of his staff.14B N.C. Admin.
