Section 8600.4 - Procedure(a) The master application procedure shall be initiated at the option of the applicant.(b) Master application project information form shall be supplied by the office. It shall be sufficiently comprehensive to allow any State agency having a possible interest in the business undertaking, project or activity to make an informed determination whether a permit may be, is, or is not required.(c) The office, upon request, may assist an applicant in filling out the master application project information form.(d) Upon receipt of a completed master application project information form, the office shall send a copy of the form to every State permitting agency it believes to have a possible interest in the business undertaking.(e) Each State agency receiving a master application project information form shall respond in writing within 15 working days of receipt of the application, with the following information and materials: (1) a listing of any permits under its jurisdiction which may be required for the business undertaking, project or activity, the application forms for such permits, a statement of what fees may be required for those permits; or(2) that no permits are required.(f) A State agency that responds that it has no interest in a master application project information form, or that fails to respond within 15 working days shall not require any permit for the business undertaking project or activity.(g) No State agency shall be barred from requiring any permit for a business undertaking, project or activity where the office determines that: (1) the information on the master application project information form was false, misleading, or materially incomplete;(2) in that situation a reasonable judgment of the agency's interest was impracticable; or(3) new permit requirements or related standards subsequently have become effective and the agency had no discretion in establishing the effective date.(h) After responses are received from the agencies, the office shall: (1) provide the applicant with all application forms and related information for those permits which the interested agencies have indicated may be required; and(2) advise the applicant to complete the application forms and return them with all necessary fees and information either to the office or directly to the agencies.(i) A master application project information form may be withdrawn at any time by the applicant without prejudice to any permit approvals pending or obtained pursuant to the master application procedure.N.Y.
