Section 8008.7 - Denial of access to records(a) Denial of access to records shall be in writing and shall: (1) state the reasons for denial;(2) advise the requestor of his right to appeal the denial to the counsel of the division; and(3) advise the requestor that he must apply for an appeal within 30 days of the receipt of the denial of access.(b) If the records access officer fails to respond to a request for information within five workdays of the receipt of the request, the failure to respond shall be deemed a denial of access.(c) If a request is not acted upon within 10 workdays after the date of acknowledgement of the receipt of a request, the failure to act may be construed as a denial of access.N.Y.
