Section 5.114 - Executive order no. 114: establishing the new york olympic games commission

WHEREAS, the XXXth Olympiad will be held in the Summer of 2012 in a location yet to be determined;

WHEREAS, NYC2012, a private nonprofit organization, has been designated by the Mayor and City Council of the City of New York to bid on behalf of New York to host the 2012 Olympic Games;

WHEREAS, New York City was one of eight cities in the United States seeking to become the United States Olympic Committee (USOC) Candidate City to the International Olympic Committee (IOC) for the 2012 Olympic Games;

WHEREAS, on October 26, 2001, New York City, along with Houston, San Francisco and Washington, D.C., was chosen as a finalist by the USOC to be the Candidate City for the 2012 Olympic Games;

WHEREAS, I proposed and recently approved legislation that would satisfy USOC and IOC requirements regarding a standby financial guaranty by the State of New York and the City of New York in support of the bid to bring the 2012 Olympic Games to New York City;

WHEREAS, a successful bid to host the 2012 Olympic Games will require the closest possible coordination between the State of New York, the City of New York, NYC2012, local elected officials and community groups;

WHEREAS, awarding the 2012 Olympic Games to New York City will result in substantial development and redevelopment in the City, cause an unprecedented number of visitors to experience the City and its many cultural, historic and recreational opportunities and stimulate greatly the economy of both the City and the State of New York; and

WHEREAS, New York State must play a vital and decisive role if the City's bid is to succeed;

NOW, THEREFORE, I, GEORGE E. PATAKI, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish the New York Olympic Games Commission.

I. Membership

The New York Olympic Games Commission ("Commission") shall consist of fifteen members. The members of the Commission shall be: the Chairman of the Metropolitan Transportation Authority or his designee, the Commissioner of the Department of Transportation or his designee, the Executive Director of the Port Authority of New York and New Jersey or his designee, the Commissioner of Environmental Conservation or her designee, the Commissioner of the Office of Parks, Recreation and Historic Preservation or her designee, the Chairman of the Empire State Development Corporation or his designee, the Chairman of the New York Convention Center Operating Corporation or his designee, and eight other members to be appointed by the Governor, who shall serve at the pleasure of the Governor. The Governor shall designate a Chairperson of the Commission from among the members of the Commission. The members of the Commission shall receive no compensation but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties. Service on the Commission shall not constitute public employment for purposes of disqualification from holding public office or employment.

II. Responsibilities and Powers

The Commission shall be responsible for overseeing and leading all efforts of State government with respect both to bringing the 2012 Olympic Games to New York City and to planning and implementing the Olympic Games should they be so awarded to New York City. In this regard, the Commission is charged with the following duties:

(1) to direct and coordinate the State's efforts in preparing for, organizing and providing assistance to the bid of NYC2012 to the USOC to be named the USOC's Candidate City for the 2012 Olympic Games;
(2) to direct and coordinate the State's involvement in preparing for, organizing and providing assistance to the efforts of NYC2012, if it is selected by the USOC as its Candidate City, to be designated by the IOC as the Host City for the 2012 Olympic Games;
(3) to direct and coordinate the State's efforts in obtaining, preparing for, organizing and providing facilities and other public improvements and the necessary public services for the 2012 Olympic Games in the event they are awarded by the IOC to New York City, and to promote the success of such Games; and
(4) to work in cooperation and assistance with the City of New York, NYC2012, the State of New Jersey and all relevant units of government to accomplish the purposes of the Commission as set out in this Order.

In addition, the Commission shall have such staff as it deems necessary to accomplish the purposes of the Commission as set out in this Order.

III. Cooperation of Other State Agencies and Entities

Each agency, department, office, division, and public authority of this State is hereby required to cooperate with the Commission and to furnish the Commission with such information, personnel, and assistance as the Commission deems necessary to accomplish the purposes of this Order.
