Section 79-4.5 - Special provisions for licensure
(a) Respiratory therapy. An applicant who is at least 18 years of age and of good moral character, as determined by the department, shall be licensed without examination provided that, prior to January 1, 1995, the applicant files an application, pays the statutory fee to the department, and:
(1) is registered by a national certifying or accrediting board for respiratory therapists acceptable to the department;
(2) prior to January 1, 1994, practiced respiratory therapy for not fewer than three years between January 1, 1989 and January 1, 1994 in a hospital in the State (hospital as defined in article 28 of the Public Health Law); or
(3) has met the educational standards of a hospital in the State (hospital as defined in article 28 of the Public Health Law) or, in the case of a hospital operated by a public benefit corporation, has met the educational standards of such corporation, and has practiced as a respiratory therapist for at least one year in such hospital.
(b) Respiratory therapy technician. An applicant who is at least 18 years of age and of good moral character, as determined by the department, shall be licensed without examination provided that, prior to January 1, 1995, the applicant files an application, pays the appropriate fee to the department, and:
(1) is certified by a national certifying or accrediting board for respiratory therapy technicians acceptable to the department;
(2) prior to January 1, 1994, practiced as a respiratory therapy technician for not fewer than two years between January 1, 1989 and January 1, 1994 in a hospital in the State (hospital as defined in article 28 of the Public Health Law); or
(3) has met the educational standards of a hospital in the State (hospital as defined in article 28 of the Public Health Law) or, in the case of a hospital operated by a public benefit corporation, has met the educational standards of such corporation, and has practiced as a respiratory therapy technician for at least one year in such hospital.
