Section 424.2 - Access to mines and mine records
(a) The department, including its employees, agents and representatives shall have the right at all reasonable times during normal business hours on normal business days, and after proper notification to the permittee and proper identification as department employees, agents and/or representatives, to enter and inspect any property or premises covered by a permit for the purpose of ascertaining compliance with title 27, the permit or this Subchapter. The permittee shall provide a person to accompany the department's representative during an inspection of the permit area when notification is provided, be it written or verbal, at least 24 hours prior to such inspection.
(b) The department, including its employees, agents and representatives, shall have access at all reasonable times during normal business hours on normal business days to mine records relative to mining and subsequent reclamation of the affected land for the purpose of ascertaining compliance with title 27, the permit or this Subchapter.
