Section 361-6.2 - Exempt FacilitiesThe following facilities and activities are exempt from this Subpart:
(a) Storage and transfer of waste tires under section 360.14(b)(9) of this Title.(b) Facilities that are registered under Subpart 361-7 of this Part and that transfer tires with storage of less than 1,000 waste tires at any time. Tires that are mounted on vehicles or that are used to support vehicles (no more than six tires per vehicle) are not included in the total.(c) The processing of waste tires at a farm by the owner of the farm for the purpose of producing a product which meets the beneficial use provisions of section 360.12(c)(2)(iv) of this Title.(d) A waste tire stockpile site undergoing abatement pursuant to the New York State Waste Tire Stockpile Abatement Plan which processes tires for the purpose of producing a product meeting any requirement of Parts 360, 362, or 363 of this Title.N.Y.
