Section 55.2 - Classifications of restrictions and public notice
(a) The entire Fort Drum Cooperator Area is restricted and limited as to its uses by the provisions of this Part.
(b) The boundaries of the area are the boundaries of the Fort Drum Military Reservation. Notice to the public of such boundaries may be given in any of the following ways:
(1) a map or other form of guidance showing the area shall be made available at the Fort Drum Range Control Building to persons checking in pursuant to this section and section 55.3 of this Part;
(2) a map or other form of guidance showing the area will be made available to each person who applies for a permit under section 55.3 of this Part; or
(3) signs giving notice of the area shall be posted at each vehicular entrance to the Fort Drum Military Reservation. Such signs shall contain the words: "Cooperative Fish and Wildlife Management Area: access by permit only pursuant to provisions of section 11-0321 of the Environmental Conservation Law." Illegible or torn-down signs shall be replaced once a year.
(c) No persons, other than authorized personnel, shall enter upon any part of the area which is designated a "closed" or "Restricted - No Trespassing Area." The boundaries of such "Restricted - No Trespassing Areas" shall be fixed by the Fort Drum military authorities. Notice to the public of the locations of such parts of the area may be given in any of the following ways:
(1) by either of the two methods established by paragraphs (b)(1) and (2) of this section; or
(2) by posting the boundaries of a "Restricted - No Trespassing Area" with signs not less than 11 inches square, not more than 600 feet apart. Such signs shall contain the words: "Restricted Area; no trespassing for any reason whatsoever." Illegible or torn-down signs shall be replaced once a year.
(d) Pursuant to Environmental Conservation Law section 11-0321(4), the restricted areas, and the different classifications thereof, shall be deemed to be in existence and subject to the regulations established in this Part when notice is given to the public in at least one of the above ways.
(e) No person, other than authorized personnel, shall enter upon any part of the area which is temporarily closed by the military authorities. It is the responsibility of each person to ascertain the location of all such places when entering the area.
