Section 47.2 - General prohibitions
(a) No person shall fail to comply with the provisions of this Part.
(b) No person shall harvest shellfish for use as food from certified shellfish lands and/or conditionally certified shellfish lands except in compliance with terms of a current order of the commissioner issued pursuant to the Environmental Conservation Law or this Part. Except as otherwise provided pursuant to the Environmental Conservation Law or this Subchapter, no person shall harvest shellfish for use as food and/or other purposes from uncertified shellfish lands if such lands have been designated by a current order of the commissioner issued pursuant to this Part, the Environmental Conservation Law or this Subchapter.
(c) Except as otherwise provided by the Environmental Conservation Law or a provision of this Subchapter, no person shall harvest shellfish from certified shellfish lands and/or conditionally certified shellfish lands without a valid shellfish digger's permit issued by the department.
(d) Nothing herein shall be construed as relieving any person from complying with any applicable Federal, State or local law or rule or regulation.
