Any part whose request for a record or records of the CDTA and its subsidiaries is denied may appeal such denial in writing, to the chairman of the Capital District Transportation Authority or the chairman of the Capital District Transit System, Capital District Transportation District Incorporated or the chairman of the Capital District Transit System, Number One, Capital District Transportation District Incorporated or the chairman of the Capital District Transit System, Number Two, Capital District Transportation District Incorporated. The party so applying shall be informed of the chairman's decision, in writing, within 10 business days of the receipt of such an appeal, and if the request is denied, shall fully explain the reasons therefor. A denial by the chairman shall be subject to review in the manner provided in article 78 of the Civil Practice Law and Rules.
