Section 5701.3 - Vehicles requiring special permits or escorts
(a) No vehicle falling within any of the following categories shall be permitted to use the facilities unless a special permit therefor is issued by the authority employee in charge, and, if required as a condition of such permit, a special escort is provided and fees, including consulting engineering services if required, therefor paid in advance, viz:
(1) vehicles having a gross weight in excess of 40 tons;
(2) vehicles having a height in excess of 14 feet 6 inches;
(3) vehicles having a width in excess of 13 feet or 156 inches;
(4) vehicles which require a special permit under the laws of the State of New York or the Province of Ontario, Canada, as the case may be, because of their length, width, height, or gross weight;
(5) vehicles transporting propane gas or any hazardous materials;
(6) vehicles which are transporting or which have recently carried explosives, radioactive materials or other dangerous commodities and show evidence or residue of such materials or commodities; or
(7) vehicles towing trailers which have pivotal front axles and double trailers being transported by one tractor and sometimes referred to as "truck trains" or "double bottoms".
(b) In determining whether or not such special permits should be issued or, if issued, what conditions should apply thereto, such authority employee in charge may confer with the authority's consulting engineers, counsel and/or whatever other specialists or regulatory agencies he may consider appropriate in the circumstances, but such determination in any given situation shall be the sole and exclusive judgment of such authority employee in charge and final and binding upon all persons. Application for a special permit shall be made at least 48 hours in advance of the proposed crossing. If permission is granted, the authority shall specify the time of the crossing.
