Section 118.3 - Hearing officers(a) A hearing officer, duly designated in writing by the Comptroller, shall preside at the hearing. At the time that the notice of hearing is sent to the person failing to report and pay or deliver abandoned property, a copy of such designation shall be sent to such person or his legally authorized representative.(b) Hearing officers are authorized to:(1) administer oaths and affirmation;(2) sign and issue subpoenas, at the request of any party, requiring attendance and giving of testimony by witnesses and the production of books, papers, documents and other evidence, and said subpoenas shall be regulated by the Civil Practice Law and Rules; and(3) regulate the course of the hearings, set the time and place for continued hearings, and fix the time for the filing of briefs and other documents. Adjournments may be granted by the hearing officer only upon good cause and presentation of a written request therefor.N.Y. Comp. Codes R. & Regs. Tit. 2 § 118.3
