Section 638.1 - Reimbursement for energy assistance(a) Reimbursement for expenditures for energy assistance provided to eligible individuals by social services districts shall be claimed on schedules and formats prescribed by the department and in accordance with instructions of the department. Any amounts for reimbursement which may be claimed as energy assistance with Federal participation must be claimed in a manner that results in the greatest proportion of Federal participation or alternatively must be claimed in a manner that does not increase the amount of State reimbursement which would be available if Federal participation were also available.(b) Expenditures made by social services districts for energy assistance provided to eligible individuals shall be subject to reimbursement, up to the limit of each district's allocation, by the State as follows. Each district may claim: (1) 100 percent of expenditures made pursuant to the Federal low-income home energy assistance program, including the cost of administration, if and for so long as Federal funds are available for the full amount of such expenditures; or(2) for expenditures made in the form of home energy grants pursuant to the Social Services Law: (i) the amount of Federal funds properly received or to be received on account of such expenditure; and(ii) 100 percent of the amount expended after first deducting therefrom any Federal funds properly received or to be received on account thereof.(c) Supplemental home energy allowances provided pursuant to subdivision 3-d of section 131-a of the Social Services Law shall be claimed in accordance with the provisions of Part 621, 625 or 626 of this Title, as appropriate.N.Y.
