Section 515.4 - Guidelines for sanctions(a) A sanction may be imposed at the discretion of the department upon a determination that a person has engaged in one or more unacceptable practices.(b) In determining the sanction to be imposed, the following factors will be considered: (1) the number and nature of the program violations or other related offenses;(2) the nature and extent of any adverse impact the violations have had on recipients;(3) the amount of damages to the program;(4) mitigating circumstances;(5) other facts related to the nature and seriousness of the violations; and(6) the previous record of the person under the Medicare, Medicaid and social services programs.N.Y.
