Section 425.5 - Eligibility for day services

State reimbursement may be provided for day services provided or purchased by local social services officials for the following individuals:

(a)
(1) persons who meet eligibility requirements under section 404.5 of this Chapter, providing the local social services district has elected to provide such services in its geographic area as outlined in the district's comprehensive annual social services plan; or
(2) persons who are served through preventive services projects which have been approved by the Department of Social Services and the State Budget Director.
(b)
(1) Prior to purchasing day services, a social services official shall ascertain from the department as to the available funding sources of which the day services facility was advised, and shall not approve the purchase of day services until he has determined that the facility has cooperated with the department in efforts to obtain funding from all available sources.
(2) Day services may be purchased from a private proprietary facility, providing that the social services official has received approval from the department to purchase from such a facility, through documenting that there is no conveniently accessible nonprofit facility which can provide such service.
(c)
(1) A local social services official shall collect fees from the parents or legal guardians of children receiving day services, providing such parents or legal guardians receive income in excess of the eligibility standards established under section 404.5 of this Title.
(2) Such fees shall be computed at a weekly rate of one half percent of the amount of annual income in excess of the eligibility standards under section 404.5 of this Title.
