Section 373-2.4 - Consideration of income and resources
(a) In determining the income and resources of applicants for and recipients of RMA, the following may not be considered by a social services district:
(1) any resources remaining in the applicant's country of origin;
(2) in-kind services and shelter provided to an applicant by a sponsor or resettlement agency;
(3) a sponsor's income and resources; and
(4) any cash grant received by the applicant under the United States Department of State or Department of Justice reception and placement programs.
(b) The social services district must base eligibility for RMA on the applicant's income and resources on the date of application. It may not use the practice of averaging income prospectively over the application processing period in determining income eligibility for RMA.
