Section 7.8.3.37 - OUTDOOR PLAY AREAS, EQUIPMENT, TOOLS, VEHICLES, AND OTHER LIKE ITEMSA. Facilities providing services to children 12 years of age and younger will have an outdoor play area, meeting the following requirements: (1) The play area should be provided with equipment appropriate to the age level of the children.(2) A play area located adjacent to a public street or highway will have the play area fenced with at least one latched gate available for emergency exits. All stationary outdoor play equipment for children should be positioned in a way that helps prevent accidents, permits freedom of action, and is securely fastened to the ground. Outdoor play equipment for children shall include energy-absorbing surfaces and be maintained in good repair at all times.B. Power-driven tools and equipment, motor vehicles, chemicals, and like items of a dangerous nature are kept locked and secured from children. Any use of such items by the children is done only under the close supervision of a staff member.N.M. Admin. Code § 7.8.3.37
