Section 8:85-3.20 - Access to information
(a) The following information maintained by the Department for the purposes of rate-setting or administering other duties under this chapter shall not be considered "government records" subject to public access or inspection within the meaning of the "Open Public Records Act," 47:1A-1 et seq.:
1. Any information derived from an NHA-100 provided by the Division of Taxation in accordance with 54:50-8;
2. "Information relating to medical . . . history, diagnosis, treatment, or evaluation" within the meaning of Executive Order No. 26 (2002);
3. "Records concerning morbidity, mortality and reportable diseases of named individuals required to be made, maintained or kept by any State or local government agency" within the meaning of Executive Order No. 9 (1963).
