Section 8:57-3.23 - Appeals
(a) An applicant that is denied enrollment as an NJIIS site or authorized user or an authorized user whose access to the NJIIS has been suspended or revoked may file an appeal as set forth in (b) below.
(b) An applicant or authorized user wishing to submit an appeal made pursuant to (a) above shall:
1. Submit two written copies of the appeal to the Commissioner within 30 calendar days of the VPDP or MCHC issuance of a letter of denial of enrollment, or suspension or revocation of access to the NJIIS at the address provided in that letter; and
2. Include in the written appeal:
i. A detailed description of the basis of the appeal;
ii. A list of all factual and legal issues;
iii. Citations to the applicable provisions of the NJIIS rules; and
iv. Any supporting documentation.
(c) The Commissioner shall give consideration only to documentation submitted pursuant to the timeframe set forth in this section in deciding upon any of the appeal issues.
(d) Within 45 calendar days of the receipt of a written appeal, the Commissioner shall render detailed findings on the factual and legal issues presented.
(e) The Commissioner's written decision shall constitute the final agency adjudication.
