Section 8:43B-3.5 - Remedy of denial of licensure(a) If the Department denies an application for an AFC caregiver license as the result of a criminal record background check, the applicant shall have the right to remedy the denial by: 1. Removing the non-client adult resident from the AFC home and re-filing the application; or2. Requesting a hearing pursuant to the Administrative Procedures Act, N.J.S.A. 52:14B-1 et seq., and 52:14F-1 et seq., and N.J.A.C. 8:43B-13 to contest the denial.(b) If the applicant fails to seek a remedy within 30 days of the date of the Department's notice of denial, the denial shall become the final agency decision.N.J.
