Section 8:28-4.3 - Appeals
(a) Whenever the Department shall find cause to deny, suspend or revoke a certificate of registration, it shall notify the registrant of the reasons for such action, in writing, and provide opportunity for a hearing in accordance with the Administrative Procedure Act, 52:14B-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1.
(b) The registrant shall file a request for a hearing within 10 business days from the date of receipt of the notice.
1. All requests for hearing shall be in writing and shall be directed to the Commissioner.
(c) The Commissioner or his or her designee shall issue the final decision in accordance with 52:14B-1 et seq. and N.J.A.C. 1:1.
