Section 8:21-7.37 - License fees
(a) The Department shall collect from each applicant for a license under the provisions of this subchapter an annual fee in the following amounts:
1. For each in-State wholesale frozen desserts establishment having an annual gross business not in excess of $ 100,000, $ 100.00; for each wholesale frozen desserts establishment with a gross annual business in excess of $ 100,000 but not in excess of $ 500,000, $ 300.00; and for each wholesale frozen desserts establishment with a gross annual business in excess of $ 500,000, $ 500.00.
2. For each out-of-State wholesale frozen desserts establishment, $ 100.00.
3. For each mobile unit, $ 50.00.
(b) Initial applications for a license to manufacture frozen desserts shall be made on the forms supplied by the Department, accompanied by the fee required in (a) above, in the form of a check or money order payable to the New Jersey Department of Health and Senior Services. Applicants shall provide all identifying information required on the form, including name, address and telephone number of the business, corporate officers and New Jersey registered agent if applicable, as well as the name and address of the source of the milk products used in the manufacturer of the frozen desserts. Applicants shall also provide the brand name under which the frozen desserts will be sold. Operators of mobile units shall provide vehicle identification and depot information, as applicable. The application shall be accompanied by the notarized affidavit of the owner or officer of the business attesting to the truth and completeness of the information supplied in the application.
(c) The Department shall send renewal applications to all licensed manufacturers of frozen desserts. The applications shall be completed and returned prior to June 30 of the application year. In no case shall a manufacturer of frozen desserts operate without a license from the Department.
1. If the manufacturer has ceased operations, the discontinuance of operations statement shall be completed and returned to the Department.
2. If the manufacturer is continuing operations, the form shall include the trade or brand name(s) of all frozen dessert products and the sources of the milk, cream or mix used in the manufacture of the products. The application for renewal shall be accompanied by the fee specified in (a) above and the notarized affidavit of the owner or officer of the business attesting to the truth and completeness of the information supplied in the application.
