Section 8:21-5.3 - Water source protection(a) The source water supply for bottled water shall be from an approved source which is properly located, protected, and operated and shall be easily accessible, adequate, and of safe, sanitary quality. The water quality and sampling frequency shall be in conformance at all times with the applicable laws and rules and regulations of the Department or other governmental agencies having jurisdiction. Examples of source water supplies which may be used for bottled water upon approval by the Department are as follows: 1. Approved public community water systems;2. Drilled and driven wells when constructed and protected in accordance with applicable standards set forth in N.J.A.C. 7:10-12, Standards for the Construction of Public Non-community and Non-public Water Systems; and3. Springs inspected for development as a water source and constructed in accordance with the applicable standards established by the Department of Environmental Protection and set forth in 7:10-12.24, Standards for the Construction of Public Non-Community and Non-Public Water Systems (springs) and shall meet the standards for springs set forth under 8:21-5.4.(b) Source water shall be evaluated according to provisions of 7:10-9.4, monitoring requirements and criteria for determination for ground water sources under the direct influence of surface water as defined under 7:10-11.4(c)1, 2, and 3. Water sources determined to be under the direct influence of surface water shall comply with the provisions of 7:10-9.1 and 9.2.N.J. Admin. Code § 8:21-5.3
